There's such a thing as unconscious bias. Some people think "is capable of saying no very firmly" is a merit in a man and a fault in a woman, but they're not deliberately trying to be sexist when they have that in mind.

They can. If someone isn't hired because of these so-called unconscious biases, it's grounds for a wrongful discrimination suit. It's happened before.

But it has to be somewhat obvious at least? To have some evidence? Email trails? Talks that leaked?

If it is just a subconscious act that was unvoiced, how do you even convict?
